KATHMANDU: Janata Samajbadi leader (JSP) Phanindra Devkota has filed a writ petition in the Supreme Court following his dismissal from the Gandaki Provincial Assembly by the CPN-Maoist Center.

Devkota was elected in the 2022 elections from Gorkha-2 using the Maoist Center’s election symbol.

The Maoist Center took action against Devkota on June 15, accusing him of violating the party’s whip by voting in favor of Gandaki Chief Minister Surendra Raj Pandey.

On the same day, Speaker Krishna Dhital read out the dismissal notice against Devkota in the Provincial Assembly.

As a result, Devkota lost his positions as a Provincial Assembly member and Gandaki’s Energy Minister.

Devkota had voted in favor of Chief Minister Pandey on June 11, helping him secure the vote of confidence.

He claimed that he acted according to NSP’s central committee directive, asserting his position as a NSP leader and Provincial Assembly member.

NSP spokesperson Krishna Sharma confirmed that Devkota filed the petition on Thursday.

“The writ has been filed in the Supreme Court against the unlawful action taken by the Maoist Center’s parliamentary party against Gandaki Provincial Assembly member Devkota,” Sharma said.

In his petition, Devkota argued that since he was elected as a NSP candidate, the Maoist Center’s parliamentary party whip in Gandaki should not apply to him.
