Supreme Court begins hearing writs against HoR dissolution

KATHMANDU: The Constitutional Bench led by Chief Justice Cholendra Shumsher Rana has started hearing the writs filed against the dissolution of the House of Representatives (HoR) on Tuesday.

The Bench comprising Chief Justice Cholendra Shumsher JB Rana, Justices Bishwombhar Prasad Shrestha, Anil Kumar Sinha, Sapana Pradhan Malla, and Tej Bahadur KC will continue hearing arguments from lawyers representing plaintiffs.

Around 300 advocates have filed their names for advocacy for or against the writ petitions related to the dissolution of HoR.

Continuing the hearing on a writ petition filed in the Supreme Court (SC) against the dissolution of HoR, the Constitutional Bench of Apex Court had kept the case in ‘on-hearing’ status on Monday.

The advocates taking part in the hearing on behalf of the writ petitioners have demanded that the decision on the case should be taken by the extended full bench, according to the SC sources.

Earlier, on behalf of the petitioners, former attorney general and advocates Raman Shrestha, Shambhu Thapa, Harihar Dahal, Dinesh Tripathi and Chandra Kanta Gyawali sought that the case should be decided by the extended full bench arguing that it does not fall under the jurisdiction of the constitutional bench.

On the contrary, Attorney General Agni Kharel and advocate Sushil Kumar Pant reiterated that the issue need not be taken to other benches and has to be settled by the constitutional bench.
