SC acquired extraordinary jurisdiction to issue ‘unconstitutional’ order: PM to SC



KATHMANDU: Prime Minister KP Sharma Oli has said the Supreme Court (SC) acquired extraordinary jurisdiction to issue an order that is in itself unconstitutional.

In his written reply to the Supreme Court (SC) on cabinet expansion, PM Oli rationalized that the Supreme Court order is against the constitution as it hampered the Executive’s effectiveness. He was of the view that the Executive should govern laws of the country and while doing so it must also work out challenges faced, and as such is the case, it is not right to stop the Executive from shuffling Cabinet to perform the Executive’s role.

“Creating a scenario where ministers cannot be appointed, the Supreme Court (SC) order hampered the effectiveness of the Executive.” He added it is unconstitutional to restrict the Prime Minister from shuffling the Council of Ministers after the House of Representatives is dissolved.
