SC issues verdict against govt’s decision to allow land fragmentation



KATHMANDU: The Supreme Court (SC) on Tuesday issued a verdict to stop land fragmentation after concluding a hearing on a writ filed against a government decision.

A bench of Chief Justice Cholendra Shumsher JBR and Justice Manoj Sharma ruled against the decision.

Earlier, a single bench of Justice Sushmalatha Mathema had issued a short-term interim order not to implement the decision.

A meeting of the Ministry of Land Management, Cooperatives and Poverty Alleviation on September 3 had lifted the ban on the land plotting imposed three years ago.

Advocate Santosh Bhandari had moved the apex court against the ministry, arguing that the decision will result in plotting on fertile land and loss of arable land

The government in a bid to preserve the arable land across the country had decided in the meeting of the Council of ministers in 2017 to prohibit the fragmentation of the plotting of the land without permission from the concerned authorities.
