Organ donation limits to ‘Only Relatives’ challenged at Supreme Court

KATHMANDU: The Supreme Court has received a petition seeking the revocation of the legal provision of confining the organ donation and reception rights to the relatives.

Claiming that the provisions in Human Organ Transplant Act 2055, violate the fundamental rights that could be safeguarded through the constitutional provision allowing the free and autonomous survival, Khem Bahadur Chhantyal, along with law students Osnik Paudel and David Chaudhary, have registered a writ petition in the apex court on Monday.

The petitioners argue that the regulation limiting organ donation exclusively from certain relatives and designated individuals, as specified in the Human Body Organ Transplantation Act 2055, encroaches upon their fundamental right to receive organs for survival.
