KATHMANDU: A writ petition seeking to reverse the government’s decision to scrap the Land-related Problems Resolution Commission has been filed in the Supreme Court.
Advocate Prabesh KC filed the writ on Friday after the government decided to scrap the commission on Tuesday, citing procedural flaw behind its formation. The commission was formed by KP Oli-led government on April 14, 2020, as part of constitutional obligations.
The Office of the Prime Minister and Council of Ministers, Prime Minister Sher Bahadur Deuba and the Ministry of Land Management, Cooperatives and Poverty Alleviation are named defendants in the writ.
Advocate KC argued that the decision of the government decision of scrapping the commission contravened Article 37 of the Constitution, which stipulates every citizen shall have the right to an appropriate housing.
The writ stated the rights of Nepali citizens, dalit community and landless citizens were affected by the government decision. The incumbent government scrapped the commission by being politically motivated without taking its ownership, it added.
The commission had appointed officials and set up offices in all 77 districts.
