SC’s full bench to offer decision for legal clarity during pandemic



KATHMANDU: The decision of the Supreme Court (SC)’s a full bench of 19 justices including the Chief Justice on clearance of legal hurdles on the issues of limitation to file case during the pandemic is to be offered on May 24.

The full bench of the SC met for the legal clarity on the issues of limitation to file case during the lockdown order issued by the government to stop the spread of the coronavirus, and it would offer its decision on coming Sunday, SC’s Assistant Spokesperson Devendra Dhakal said.

The bench would take a decision to clear the obstacle as the difficult situation was witnessed over the limitation in the filing of case, notice, and handing overdue date and date of presence owing to the recent government order on lockdown.

The full complete bench includes Chief Justice Cholendra Shumsher JBR and Justices Dipak Kumar Karki, Meera Khadka, Hari Krishna Karki, Bishambhar Prasad Shrestha, Ishwar Prasad Khatiwada, Ananda Mohan Bhattarai, Anil Kumar Sinha, Prakashman Singh Rawat, Sapana Malla, Tej Bahadur KC, Purushottam Bhandari, Bam Kumar Shrestha, Tanka Bahadur Moktan, Prakash Kumar Dhungana, Sushmalata Mathema, Kumar Regmi, Hari Prasad Phuyal and Manoj Kumar Sharma.

Though the Constitution of Nepal has the provision to clear constitutional and political deadlocks, the bench is expected to ensure legal clarity on how the judiciary shall function during the pandemic. Prior to this, the SC sought opinions of the Attorney General, Nepal Bar Association and Supreme Court Bar Association on this matter.

It may be noted that the government is carrying out its works on prevention and control of the coronavirus on the legal basis of the Infectious Disease Control Act, 1964.
