KATHMANDU: The Supreme Court (sc) has upheld the appointments of 52 constitutional office bearers, declaring them valid despite ongoing disputes.
In a verdict announced at midnight, a five-judge bench ruled by a 3-2 majority to uphold the appointments. Three judges ruled the appointments legal, while two dissented, favoring annulment. The majority decision is final, thereby securing the positions of the 52 office bearers.
These appointments were made by the government led by then Prime Minister KP Sharma Oli, who appointed members to various constitutional bodies twice through ordinances in 2077 and 2078 BS.
Senior advocate Dinesh Tripathi, advocate Om Prakash Aryal, and others filed writ petitions challenging the legality of the appointments.
At the time, only Oli, Chief Justice Cholendra Shumsher Rana, and then National Assembly Chairman Ganesh Prasad Timilsina were present in the Constitutional Council led by Oli.
The then Speaker Agni Prasad Sapkota and opposition leader Sher Bahadur Deuba were absent from the meeting.
