SC issues interim order against the government’s decision to restrict protests



KATHMANDU: The Supreme Court has issued an interim order against the Home Ministry’s decision to restrict the protests and freedom of expression.

A division bench of Justices Meera Khadka and Tej Bahadur KC passed the order on Monday.

The Ministry of Home Affairs had issued a notice on September 5 warning not to burn the effigy of the Prime Minister of the neighboring country and had warned to take action against those involved in such activities.

Advocate Prabesh KC had filed a writ petition against the Ministry’s warning notice. The writ petition claimed that the government’s move was aimed at curtailing freedom of expression.

The petitioner argued that Home Ministry’s notice was against the right to freedom of thought and expression given by the Constitution.

The Supreme Court has issued an interim order not to implement the decision, saying it has stifled freedom of expression ensured as fundamental rights in Article 17 of the Constitution.
