SC orders original file in Durga Prasai habeas corpus petition



KATHMANDU: The Supreme Court of Nepal has ordered the original file to be produced in connection with a habeas corpus petition filed by medical entrepreneur Durga Prasai.

A joint bench of Justices Dr Nahakul Subedi and Meghraj Pokharel on Monday directed the Office of the Attorney General to present the original documents related to the case.

The order was issued during a hearing on the habeas corpus petition filed on behalf of Prasai. The bench sought the file based on a written response submitted by the District Police Range, Kathmandu.

According to the court order, the written response from the police stated that Prasai had been arrested following a letter dated 2082/11/04 from the Election Commission of Nepal instructing authorities to investigate and take action against him.

Stating that the arrest was carried out as per the Commission’s correspondence, the bench ordered that the original file, including the Commission’s decision to initiate investigation and action against the petitioner, be produced through the Office of the Attorney General.

The court has scheduled the next hearing in the case for Tuesday.
Police, in their written reply, had mentioned that Prasai was taken into custody following official communication from the Election Commission. The apex court has now sought the Commission’s letter and the original investigation file for further examination.
