Road Division issues 15-day ultimatum to remove illegal structures encroaching Mahendra and Tribhuvan highway



KATHMANDU: The Makwanpur Road Division Office has issued a 15-day ultimatum to remove illegal structures built by encroaching on the Mahendra Highway and Tribhuvan Highway.

In a notice published on Friday, the Division said several permanent and temporary structures have been constructed by occupying road land in the Ratamate–Buddhachowk–Rapti Bridge and Buddhachowk–Samari Bridge sections of Hetauda Sub-Metropolitan City.

The office had previously issued multiple notices to clear the encroached areas. However, instead of complying, the owners of the structures filed writ petitions at the Supreme Court demanding compensation.

The Supreme Court had already dismissed the petitions, one on January 3, 2022 and another on June 25, 2023, upholding that the structures were unauthorized.

Despite the court’s ruling, the structures remained in place for four years, prompting the Division to issue a fresh 15-day ultimatum. The notice warns that if the structures are not removed within the stipulated time, the office will forcibly demolish them and recover the demolition costs from the owners.

The Road Division also cited the Public Roads Act 1974, which designates 25 meters on both sides of the road as the official highway boundary and prohibits constructing structures within this zone without approval.
