Supreme Court dismisses writ petition against expansion of road in Birgunj



BIRGUNJ: The Supreme Court has dismissed a writ petition filed against the expansion of Birgunj’s main road. The case remained sub judice since the past five years.

Five separate petitioners, homeowners from Birgunj, had filed a writ petition in the Supreme Court, saying that the main road section of Birgunj should not be widened by 25 meters on both sides.

Among them, Laxman Shah Rauniyar of Birgunj Municipal Corporation had filed a writ petition in 2076 BS, demanding that the road expansion be stopped.

He had named the Office of the Prime Minister and Council of Ministers as the defendants. Other petitioners had also filed writ petitions against the road expansion on different dates.

A joint bench of Supreme Court Justices Binod Sharma and Mahesh Sharma Poudel on Wednesday dismissed all five writ petitions, paving the way for the Division Road Office, Hetauda, to widen the main road section of Birgunj by 25 meters each on both sides. The road expansion work had been stalled since the writ was filed.

The work on the main road expansion from Gandak Chowk to Power House Chowk, Ghantaghar Chowk to Ardash Nagar, Rajat Jayanti Chowk, Shankaracharya Gate to Miteri Bridge under the Tribhuvan Highway had remained stalled since the case was filed against it.
