Writ filed in SC demanding cancellation of decision not to prosecute Lilaballav



KATHMANDU: A writ petition has been filed in the Supreme Court (SC) seeking the cancellation of the decision not to prosecute former Koshi Province Minister Lilaballav Adhikari.

Senior advocate Dinesh Tripathi, who filed the petition, has urged the SC to overturn the decision and order a fresh investigation that could lead to formal charges being filed against Adhikari.

Tripathi argues that the decision not to prosecute Adhikari was made in bad faith and should be immediately annulled.

Adhikari was detained upon his return to Nepal after traveling to Japan to attend an event organized by the Tokyo Metropolitan Government and the Art Council Tokyo. However, following a decision by the District Government Attorney’s Office in Kathmandu not to pursue charges, Adhikari was released from custody.

Three other individuals who accompanied Adhikari to Japan—Janak Rai, Dawa Sherpa, and Kanchan Devkota—were questioned at Narita Airport’s immigration office in Japan. All four individuals, including Minister Adhikari, were subsequently deported by Japanese immigration authorities.

Upon their deportation, the Immigration Department handed over Rai, Sherpa, and Devkota to the Valley Crime Investigation Office for further investigation.
