Hearing of case against Koshi government to continue on June 23

KATHMANDU: The hearing of the writ against the formation of the Koshi Province government will continue on June 23.

The hearing, conducted by a full bench at the Supreme Court on Thursday, was rescheduled after it was not concluded.

Former Chief Minister Kedar Karki filed the writ petition in the Supreme Court, arguing that the formation of the new government is unconstitutional according to sub-section (5) of Article 168 of the Constitution.

The hearing was conducted by a full bench of judges Kumar Regmi, Nahakul Subedi, and Abdul Aziz Musalman.

Previously, a bench comprising Justices Til Prasad Shrestha and Balkrishna Dhakal directed that the writ be forwarded to the full bench for further hearing.

Karki’s petition demands the removal of the current Chief Minister Hikmat Karki and his own reinstatement as Chief Minister.

The respondents named in the writ include the Office of the State Chief, Koshi State Chief Parasuram Khapung, and Koshi State Assembly Speaker Amar Bahadur Bista, among others.

Hikmat Karki secured the Chief Minister position with the support of 52 MPs from the CPN-UML and CPN-Maoist Center.

Following the identification of the members, Provincial Chief Khapung appointed Hikmat Karki as Chief Minister under clause (5) of Article 168 of the Constitution.
