Govt’s constitutional validity ends on Apr 5 if vote of confidence not taken: Maoist Center

KATHMANDU: Chief Whip of Communist Party of Nepal (Maoist Center) Dev Prasad Gurung has questioned at the status of the incumbent government if it did not take a vote of confidence by April 5.

Speaking at a special session of the House of Representatives today, Chief Whip Gurung said that the constitutional status of the government would be questioned if a vote of confidence was not received within that period.

He reminded that getting a vote of confidence by April 5 is mandatory for the government as the erstwhile ruling Nepal Communist Party was annulled after the Supreme Court (SC) verdict of March 7.

“The Prime Minister may, if his or her party is fragmented or the coalition partner withdraws its support, to obtain a vote of confidence from the members of the House of Representatives, table a resolution to that effect in the House of Representatives within thirty days,” Gurung quoted Article 100 (2) of the Constitution and claimed,” As the ruling party has split with SC verdict, the constitutional status of the government can be questioned if it does not take  a vote of confidence by April 5.”

He also accused the government of dissolving the House of Representatives not to take people’s mandate but merely to make the Constitution a failure by making mockery of the major achievements of people’s movement reflected in the Constitution.
