KATHMANDU: Hearing on the writ petition filed against the government’s decision to dissolve the House of Representatives continued at the Supreme Court today, the 11th day of debate.
The hearing is taking place before the Constitutional Bench led by Chief Justice Cholendra Shumsher JB Rana.
Nepal Bar Association Chair Chandeswar Shrestha, senior advocate Mukti Pradhan, Tulasi Bhatt, Hari Upreti, advocate Govinda Sharma Bandi and Gopal Krishna Ghimire put forth their arguments in favor of the writ petition.
Senior advocate Shrestha argued that the Constitution does not have any provision for the dissolution of the HoR, and if it has to be done then it could be done only by amending the national statute.
Senior Advocate Upreti said the written response to the apex court by the Prime Minister does not spell out the Article of the Constitution that was used to recommend dissolution of the lower house.
Advocate Bandi demanded that the HoR be reinstated as the Constitution does not have any provision to dissolve the HoR.
Other advocates argued that the new Constitution avoided the provision of dissolving the house, learning upon the lessons of the past. The hearing will continue Friday.
