Parliament cannot be dissolved without forming govt as per Article 76 (5): Senior Advocate Bhandari



KATHMANDU: Senior Advocate Sabita Bhandari has said that as the application submitted by Nepali Congress parliamentary party leader Sher Bahadur Deuba seeking the appointment at the post of the Prime Minister as per Article 76 (5) is legal, he should be appointed as the Prime Minister.

Taking part on Sunday’s debate before the Constitutional Bench on Sunday, senior advocate Bhandari said that the House of Representatives could not be dissolved without appointing Deuba as the basis for Article 76 (5) is strong for Deuba being appointed the Prime Minister.

“Prime Minister KP Oli has no right to recommend the dissolution of parliament. There can be no dissolution without forming a government as per 76 (5) of the constitution,” she said.

Stating that Article 76 (5) of the constitution is a provision for the parliamentarians to form a government after the parties failed to form a government together, senior advocate Bhandari claimed that the court should decide accordingly.

“Those who were assigned to make history ruined it. Now an independent and correct verdict is expected from the court,” she added.
