 Constitutional Bench related hearing postponed due to amicus curiae’s absence

KATHMANDU: The hearing of a writ petition filed in the Supreme Court seeking the mandatory presence of Chief Justice Cholendra Shumsher Rana in the Constitutional Bench has been postponed citing the absence of amicus curiae members.

According to sources, the hearing was affected as the Nepal Bar Association (NBA) did not officially send the name of Amicus Curiae. The division bench of Justices Prakash Kumar Dhuganna and Dr. Manoj Kumar Sharma was scheduled to hear the petition.

Advocate Dr. Ganesh Regmi had filed a writ petition demanding that the Chief Justice should be mandatory in the Constitutional Bench.

The issue of whether the Chief Justice should sit in the Constitutional Bench to hear the writ petition against the appointment made by the Constitutional Council was also debated in the bench.

SC administration informed that the apex court had written to NBA to send the list of the lawyers to take part in the hearing as amicus curiae.

A single bench of Justice Hari Prasad Phuyal had issued an interim order on September 3 to call for the amicus curiae.
