SC orders govt not to collect tax during prohibitory order



KATHMANDU: The Supreme Court has issued an interim order Wednesday directing the government not to collect taxes and levy fines during the period of prohibitory order.

It has asked the government to make arrangement for collecting taxes within 30 days after the prohibitory order is completely lifted.

The single bench of Justice Meera Khada issued the order after hearing a writ filed by Advocates Shrijana Adhikari and Shailendra Upreti.

“Although it is the duty of the taxpayer to file all tax returns under normal circumstances, the taxpayer is not able to file the tax returns and tax returns in the situation of closure due to COVID 19,” the SC order reads. The order noted that tax payers were also affected by the prohibitory order.

The Ministry of Finance has been asked to submit a written reply through the Attorney General’s Office within 15 days.
