Majority-led PM can dissolve parliament: Senior Advocate Mainali

KATHMANDU: Taking part on the debate on the dissolution of House of Representatives (HoR) on behalf of the amicus curiae, Senior Advocate Bijaya Kant Mainali argued that the majority led Prime Minister can dissolve the HoR.

“Article 76(7) of the constitution has granted the majority led Prime Minister to dissolve the HoR,” Senior Advocate Mainali spoke to the constitutional bench hearing the case against the dissolution of HoR.

He further elaborated that when no party takes initiation to form the government, the majority leading Prime Minister can dissolve the HoR.

One of the amicus curiae, in this case, Senior Advocate Mainali cited the instance of Nepali Congress Supreme Leader Ganesh Man Singh and said that there can be some people who might deny becoming the Prime Minister.

“When there is confusion within the party, the problems arise and such problems might blur the chances of forming the next government, in that case, the PM can dissolve the government,” he said.

Arguing that the Prime Minister recommended the dissolution due to the conflict within the party, he claimed that in the past also then Prime Minister Girija Prasad Koirala, Sher Bahadur Deuba and Man Mohan Adhikari had dissolved the parliament due to the disputes within the party.
