Amicus curiae starts debating on HoR dissolution case

KATHMANDU: The amicus curiae has started debating before the Constitutional Bench of the Supreme Court (SC) on writs filed against House dissolution.

The writ petitioner’s turn to respond to the lawyers’ argument defending the dissolution of the House of Representatives (HoR) ended on Monday.

The Supreme Court had demanded three persons from Nepal Bar Association (NBA) and two persons from Supreme Court Bar Association to take part in the debate on the dissolution of the HoR case.

Accordingly, NBA has selected Badri Bahadur Karki, Vijay Kanta Mainali, and Satish Krishna Kharel to take part in the debate on behalf of the Bar and Supreme Court Bar has selected Purna Man Shakya and Geeta Pathak to take part in the debate as Amicus Curiae.

They will give their opinion to the court without taking the side of either party. The Constitutional Bench will give its verdict after the amicus curiae’s opinion.

Earlier, the Bench had heard the argument of the lawyers speaking on behalf of the writ petitioners on Sunday and Monday.

Those lawyers had replied to the counter-arguments of the lawyers defending the government’s decision to dissolve the HoR.

The bench led by Chief Justice Cholendra Shumsher Rana, with justices Bishwombhar Prasad Shrestha, Anil Kumar Sinha, Sapana Pradhan Malla, and Tej Bahadur KC is hearing the cases related to the dissolution of HoR.
