KATHMANDU: The Constitutional Bench led by Chief Justice Cholendra Shumsher Rana has started hearing the writs filed against the dissolution of the House of Representatives (HoR) on Friday.
Today’s hearing will be focused on whether the case be decided through the Constitutional Bench or the Extented Full Bench.
Led by CJ Rana, the Constitutional Bench has Justices Bishwombhar Prasad Shrestha, Sapana Pradhan Malla, Anil Kumar Sinha and Tej Bahadur KC as members.
Continuing the hearing on a writ petition filed in the Supreme Court (SC) against the dissolution of HoR, the Constitutional Bench of Apex Court had kept the case in ‘on-hearing’ status on Wednesday.
The advocates taking part in the hearing on behalf of the writ petitioners have demanded that the decision on the case should be taken by the extended full bench, according to the SC sources.
On behalf of the petitioners, former attorney general and advocates Raman Shrestha, Shambhu Thapa, Harihar Dahal, Dinesh Tripathi and Chandra Kanta Gyawali sought that the case should be decided by the extended full bench arguing that it does not fall under the jurisdiction of the constitutional bench.
On the contrary, Attorney General Agni Kharel and advocate Sushil Kumar Pant reiterated that the issue need not be taken to other benches and has to be settled by the constitutional bench.
As the hearing on the case was not finished on Wednesday, it was scheduled for today.
