Four former Chief Justices term HoR dissolution unconstitutional

KATHMANDU: Four former Chief Justices have called Prime Minister KP Oli’s move to dissolve the House of Representatives (HoR) unconstitutional.

Former Chief Justices Min Bahadur Rayamajhi, Anupraj Sharma, Kalyan Shrestha, and Sushila Karki issued a joint statement on Friday terming the move unconstitutional.

They have claimed that Article 76 of the Constitution of Nepal 2072 BS does not provide the right for dissolving the House of Representatives except in relation to the formation of the Council of Ministers.

Former Chief Justices have said that the unexpected dissolution of parliament has had an unforeseen adverse effect on the implementation of the country’s constitutional system, political stability, good governance, and development environment.

They have warned that giving legitimacy to the dissolution of the Parliament could create a situation of constitutional disorientation.

Four former Chief Justices have said that dissolving the Parliament by ignoring the provisions of the constitution for the stability of the House of Representatives and the government is an unusual political and constitutional impasse.

Pointing to the court, they have said, “We urge all concerned to work for democracy, the rule of law and development so that such acts never happen again and to improve the current stalemate.”
