Chief Justice Rana warns of suing on defamation allegation



KATHMANDU: Chief Justice Cholendra Shumsher Rana warned on Sunday that the lawyers raising undue concerns against the justices might be sued for defamation.

During Sunday’s session of the Constitutional Bench, Chief Justice Rana stated that his duty was to remind the lawyers about the legal provisions regarding the defamation allegation and also added raising baseless concerns against the justice is an offence.

During the debate in the Constitutional Bench, when Attorney General Ramesh Badal and other lawyers raised questions objecting to the reformation of the Constitutional Bench and inclusion of two justices of the previous bench in the new one, the Chief Justice, in a tone of warning, said raising undue questions against the judges is an offence.

“It is my duty to remind the petitioners that the petitioners who raise baseless concerns against the judges can be tried as per clause 37 of the Justice Administration Act,” he said before the tea-break on Sunday.

Earlier despite Chief Justice Rana’s request not to complicate the case by filing writ petitions against the justices in the bench, advocates Deepak Mishra, Rajaram Ghimire, Yagyamani Neupane and Krishna Prasad Bhandari, had filed a case saying the eleven justices in the Supreme Court rosters could not join the hearing on the writ petition against the dissolution of the House of Representatives.
