KATHMANDU: Chief Justice Cholendra Shumsher Rana has said that he did not sign the order on May 30 so that the debate on the formation of the Constitutional Court could go into intellectual discussion and his partisanship could not be seen anywhere.
Responding to the queries about the cause of Chief Justice’s not signing the May 30 verdicts of either of the members of the constitutional bench, Chief Justice Rana replied during the Constitutional Bench’s hearing on Sunday that he did not sign on either of the verdicts of contradicting versions of the justices of then Bench so that such issues could draw further attention for intellectual discussion.
Earlier Attorney General (AG) Ramesh Badal and former AG Agni Kharel had raised concern over Chief Justice not signing the documents.
“I did not sign the decisions of either of the justices on May 30, so that it could be a subject to debate of intellectual discussion,” Chief Justice Rana explained.
Earlier, two judges had quit the bench after the lawyers of the writ petitioner raised questions about the formation of a constitutional bench. However, other two judges, against whom the questions were raised, had refused to leave the bench.
Although the four judges read out their opinions, the chief justice had not issued any order or opinion.
