SC issues show-cause notice over appointments to constitutional bodies

KATHMANDU: The Supreme Court (SC) has issued a show-cause notice in the name of defendants regarding the appointments to various constitutional bodies.

Senior Advocate Dinesh Tripathi had filed a writ petition arguing that the recommendation made for appointment to various constitutional bodies was unconstitutional.

A single bench of Justice Kumar Regmi issued the show-cause notice while conducting a preliminary hearing on the writ on Friday.

Petitioner Tripathi, Senior Advocate Shambhu Thapa, and Advocate Om Prakash Aryal argued on behalf of the petitioner.

Senior Advocate Tripathi had filed a writ petition on Wednesday seeking prohibition of 32 heads and office bearers of the constitutional bodies who took the oath of office and secrecy.

In the writ petition, Advocate Tripathi has demanded an order not to implement the decision of the Constitutional Council.

It has been mentioned in the writ that the ordinance brought by the government has violated Articles 2, 83, 284, and 292 of the Constitution.

According to Tripathi, the ordinance on the Constitutional Council (CC) is unconstitutional saying that three out of the six members of the CC cannot make a decision and the constitution does not envisage appointments to those commissions without a parliamentary hearing.
