‘Amendment to rules redundant for Constitutional Bench formation’

KATHMANDU: An amendment of rules will not be necessary for forming a constitutional bench to hear the issue of dissolution of the House of Representatives (HoR).

An online meeting of the Full Court comprising all the judges of Supreme Court held on Zoom on Friday concluded there is no need of amending the rules to form a constitutional bench with senior judges and it could be formed under the current framework of rules.

Earlier, Supreme Court officials had met Chief Justice Cholendra Shamsher Rana and suggested amending the rules to ensuring the constitutional bench is always comprised of senior judges.

Chief Justice Rana had also directed Chief Registrar Lal Bahadur Kunwar to prepare a draft amendment to the rules, said Purnaman Shakya, Chairman of the Supreme Court.

The HoR hearing was adjourned till June 8 in order to go through the trouble to amend rules to form a constitutional bench with senior judges. Apparently, a constitutional session could well be created from the existing roster of judges.

Also, Friday’s meeting has decided to continue the current system by processing only issues related to habeas corpus and constitutional issues during the prohibitory period.
