Single bench of Justice Phuyal hearing writ against CJ’s involvement in Constitutional Bench

KATHMANDU: A single bench of Justice Hari Prasad Phuyal is scheduled to hear the writ petition filed at the Supreme Court (SC) seeking a Constitutional Bench (CB) without the Chief Justice today.

The SC has assigned Justice Phuyal to hear the writ petition demanding that the constitutional bench should be without the Chief Justice arguing that to look into one’s own case would breach the principle of natural justice.

“A writ petition filed against involvement of Chief Justice in the Constitutional Bench has been assigned at the single bench of Justice Hari Prasad Phuyal. He is hearing the writ petition today,” said Kishor Paudel, the information expert at the SC.

Advocate Deepak Bikram Mishra had filed a writ petition at the Supreme Court demanding the Constitutional Bench without the Chief Justice arguing that his/her involvement in the bench would infringe on the principle of natural justice.

Similarly, advocate Dr Ganesh Regmi had filed a writ petition demanding that Chief Justice should be in the Constitutional Bench.
