Local representatives can draw only perks: Supreme Court



KATHMANDU: The Supreme Court (SC) has stated that the local level representatives can draw only perks and not salary.

Making public the detailed verdict announced on October 18, the apex court maintained that the representatives drawing monthly salary was against the constitution.

The apex court stated that local representatives are entitled to facilities as per the state laws but can’t receive facilities as against the constitution.

The apex court maintained that the acts formulated by the states were against Article 220 (8) and Article 227 of the constitution, according to advocate Oli.

A Constitutional Bench comprising of Chief Justice Cholendra Shumsher JBR, Justices Deep Kumar Upadhyaya, Kedar Prasad Chalise, Meera Khadka and Hari Krishna Karki had issued the verdict that office-bearers and members of the local levels have been receiving pay and perks was against the constitution.

Hearing a writ filed by advocate Lokendra Bahadur Oli, the apex court had annulled the annexes under Clause 3 of the acts related to pay and perks formulated by Province 2, Province 3, Gandaki Province, Province 5, Karnali Province and Sudurpaschim Province.

The petitioner had named the governments of Province 2, Province 3, Gandaki Province, Province 5, Karnali Province and Sudurpaschim Province, Ministry of Internal Affairs and Law of those provinces as defendants.
