KATHMANDU: The hearing regarding the petition seeking the suspension of Deputy Prime Minister and Home Minister Rabi Lamichhane concluded on Monday.
Justices Manoj Kumar Sharma and Til Prasad Shrestha presided over the proceedings, which will now lead to a decision on whether to grant an interim order, dismiss the writ, or request further evidence.
If an interim order is issued by the Supreme Court, Home Minister Lamichhane could face challenges.
Conversely, he may find relief if the court decides against issuing interim measures.
In related news, the case against Home Minister Lamichhane has progressed to the Supreme Court, with preparations underway to request time for arguments before the bench.
Previously, Justice Shrestha’s bench scheduled a priority discussion and requested written responses, along with ordering the withdrawal of a complaint filed with the Kaski police.
Despite being cleared by the Attorney General’s office, which stated the absence of any ongoing investigations, indictments, or complaints against him, Lamichhane’s position remains contentious.
Advocates, including Anupam Bhattarai, filed a writ challenging the validity of the Attorney General’s letter. Initially rejected, a subsequent writ was accepted following a bench directive.
The writ contends that Lamichhane, as Home Minister, should be suspended due to his leadership role within the investigating body.
It argues that until he steps down from this position, the allegations of cooperative fraud against him cannot be thoroughly investigated.
Additionally, it notes pending complaints against Lamichhane with the Kaski Police and his inclusion in charge sheets from other districts.
