Decision awaited as Patan High Court concludes hearing on Khand’s petition

KATHMANDU: The court hearing concerning Bal Krishna Khand, former Home Minister currently in custody alleged of involvement the fake Bhutanese refugee case, has concluded at the Patan High Court.

Legal professionals representing both Khand and the government presented their arguments, leaving the case’s verdict pending from Judge Krishna Ram Koirala’s bench.

Previously, Judges Janak Pandey and Prakash Kharel held conflicting opinions on whether to grant bail or keep the former minister in custody.

The forthcoming decision, scheduled for Thursday, will determine whether Khand remains incarcerated or is released on bail.

Advocates including former Attorney General Kham Bahadur Khati, Surendra Mahato, Krishna Prasad Sapkota, Mahadev Yadav, and Harihar Dahal argued in favor of Khand during the hearing.

Similarly, advocates Prem Bahadur Khadka, Gopal Krishna Ghimire, and Bishwanath Khanal presented their case.

Senior government lawyers, Mahesh Khatri and Shankar Khatri, made their arguments, followed by counterarguments from Khand’s legal team.

Khand’s lawyers insisted on upholding Judge Pandey’s order for his release, emphasizing that imprisonment would jeopardize his political career.

In contrast, government lawyers pressed for adherence to Judge Kharel’s decision to keep Khand in jail.

Former Attorney General Khati, advocating for Khand, asserted that releasing him would ensure his political future, maintaining that a guilty verdict should only be reached after the case’s finalization.
