SC establishes dedicated bench for family dispute cases

KATHMANDU: The Supreme Court (SC) has established a specialized bench exclusively dedicated to handling cases related to family disputes. The inauguration of this new initiative was officiated by Chief Justice Bishowambhar Prasad Shrestha on Monday.

The inception of this specialized family dispute bench follows Chief Justice Shrestha’s presentation of an action plan during his parliamentary hearing, outlining the need for a dedicated forum within the court to address family-related legal matters.

As part of the same action plan, the Case Management Committee at the apex court has now resolved to commence the operations of two distinct benches solely dedicated to family dispute cases, effective immediately.

The newly formed family court will assume jurisdiction over civil cases concerning various aspects of child welfare, including issues involving women plaintiffs, domestic relationships, cases of domestic violence, and cases filed on behalf of minors requiring special care and guardianship.

Chief Justice Shrestha, expressing his satisfaction with the establishment of the family court in accordance with the action plan presented to the parliamentary hearing committee, underscored the court’s commitment to expeditiously adjudicate cases involving women, ancestral property inheritance and distribution related disputes, relationship matters, domestic violence, and child-related issues.

“I am now confident that swift and dependable justice will be provided to women,” the Chief Justice said.

Additionally, every judge assigned to the family dispute bench has been tasked with comprehending its objectives and responsibilities. Chief Justice Shrestha also revealed plans to extend the establishment of family courts to other districts within the Kathmandu Valley, further enhancing access to justice in family-related disputes.
