Senior Advocate Thapa says SC should reinstate House and set date for its meeting



KATHMANDU: Senior Advocate Shambhu Thapa has demanded that the Supreme Court (SC) should set a date for the meeting while giving a verdict to reinstate the House of Representatives (HoR.

Taking part in the defense debate on behalf of the writ petitioner regarding the dissolution of the HoR on Monday, Thapa said that when the SC itself sets the date for the session, the Prime Minister has to attend the meeting called by the Speaker of HoR.

“When the parliament is reinstated, it should be decided when to hold a meeting; in that case, the Speaker will call the meeting and the Prime Minister has to be present,” former President of Nepal Bar Association Thapa said before the Bench hearing the case against the dissolution of HoR.

Earlier, the lawyers speaking on behalf of dissolution had argued what would happen if the PM refused to recommend to call or attend the meeting called by the Speaker.

Arguing that what is not written in the constitution cannot be exercised as a privilege by the PM, Thapa claimed that there is no precedent in the world where Prime Minister is empowered by interpretation.

“There is no precedent in the world for the Prime Minister to be empowered by interpretation of the Court, rather there are many instances which have curtailed the prerogatives of the Prime Minister,” Thapa argued before the Bench adding, “Let Nepal not be the exception in such case through this case.”
