KATHMANDU: Senior Advocate and Member of National Assembly Ram Narayan Bidari has remarked that the Supreme Court should not bother much about whether the House of Representatives (HoR) can find a new Prime Minister or not as it’s the issue to be tried by the sovereign parliament itself.
Taking part in the discussion related to the writ petitions against the dissolution of HoR in the Constitutional Bench, lawmaker Bidari reminded the court that since the functions like forming or changing the government are the functions of the legislature, the judiciary need not bother about whether the legislature can do it or not unless the former seeks help for a way out.
“Who changes the government, is it the court? No, it is the function of parliament; hence the parliament should know how many members are there and how the next government should be formed,” one of the lawmakers who had been in many committees during the constitution-making procedures Bidari told the Bench hearing on the issue, adding, “Prime Minister Oli’s claim that there is no alternative for the new government is not true. How can one expect fruits from the tree that’s felled down?”
He remarked that PM Oli has got parliament phobia and added that the court should uphold constitutionalism.
He scoffed at PM Oli for playing the game on the people rather than playing it at the party and called him ‘hapless’.
Chief Justice Cholendra Shumsher Rana reminded senior advocate Bidari not to use the derogatory term against the PM.
Bidari demanded that the Supreme Court overturn the decision to dissolve the HoR as it is the only way to let the spirit of the constitution remain intact.
