CJ Rana asks govt side if the interpretation offered by 11-member bench be overruled by a less judge



KATHMANDU: Chief Justice Cholendra Shumsher Rana asked government side whether the 11-member bench’s earlier interpretation of the dissolution of the parliament could be overturned by a bench of lesser judges.

During the hearing against the dissolution of the House of Representatives (HoR) in the Constitutional Bench of the Supreme Court on Wednesday, Chief Justice Rana remarked that the 11-member bench of justices had looked in the matter in the past and questioned why should it not be taken to the Extended Full Bench now.

Taking part in the hearing the advocates of the writ petitioner’s side demanded that the matter be taken up in a plenary session. However, the attorney general opposed to the proposal and said that it was not necessary to take the issue to the extended full bench as the issue was not worth taking there.

Attorney General Kharel pointed out that handing over such cases to the plenary session would weaken the role of the Constitutional Bench.
