SC declines to stay Samajwadi Party’s decision to expel Giri

KATHMANDU: Supreme Court of Nepal has declined to stay Samajwadi Party Nepal’s decision to expel lawmaker Sarita Giri from the party.

Hearing the writ petition filed by lawmaker Giri on Sunday, a joint bench of Justices Ishwor Prasad Khatiwada and Ananda Mohan Bhattarai refused to stay Samajwadi Party’s decision to expel her.

Samajwadi Party on July 7 had expelled lawmaker Giri from the party for not abiding by the party’s whip concerning the Constitution amendment bill brought to implement Nepal’s revised map in the coat of arms.

On July 12, Giri had filed a writ petition at the Supreme Court against the Samajwadi Party Nepal’s decision to dismiss her from the Parliament and the party.

Giri in the writ petition had argued that the Executive Council of Samajwadi Party has no right to terminate her but it is the Central Committee that retains the right to decide on this issue.

The SC has turned down Giri’s petition arguing that the decision has been made in line with her party’s statute.
