KATHMANDU: The Supreme Court has refused to issue an interim order seeking to halt the 15th General Convention of the main opposition Nepali Congress.
A bench comprising Justices Nahakul Subedi, Mahesh Sharma Paudel and Meghraj Pokharel refused to issue the interim order on Thursday.
Former Nepali Congress president Sher Bahadur Deuba and former acting president Purna Bahadur Khadka had filed a supplementary petition seeking an interim order to stop the party’s 15th General Convention.
The Supreme Court said there was no prima facie basis for issuing an interim order, noting that an earlier petition had already been dismissed without directing or ordering the implementation of the decision.
The Election Commission had recognised the committee led by Gagan Kumar Thapa on January 16, 2026. A joint bench of the Supreme Court had also upheld the commission’s decision and dismissed the writ petition filed by Deuba and Khadka on April 17, 2026.
The court noted that the earlier order had not directed either the petitioners or the respondents to undertake or refrain from any action or decision. The full bench on Thursday cited this as a key basis for refusing the interim order.
The Supreme Court also addressed the legal provision under Section 231(e) of the Civil Procedure Code, 2017, concerning suspension of the implementation of a judgment pending the outcome of a review. However, since the writ petition itself had been dismissed, the court declined to issue the requested interim order.
