Deuba withdraws writ from Supreme Court, citing errors



KATHMANDU: Former Nepali Congress (NC) President Sher Bahadur Deuba has withdrawn a writ petition filed in the Supreme Court seeking to halt the party’s 15th General Convention, citing errors in the petition.

Deuba filed the writ through his lawyers on Friday afternoon. Supreme Court spokesperson Arjun Koirala said the petitioner withdrew it while the court was still examining the case for registration.

According to Koirala, the writ had been submitted and was under preliminary examination but had not yet been registered. The petitioners said they would correct the errors and submit it again.

The writ sought to halt the entire process of the NC’s 15th General Convention. Deuba’s side is seeking to stop the convention even as the Supreme Court has already allowed a review of its earlier decision upholding the Election Commission’s recognition of the NC committee led by Gagan Thapa.

Deuba and former Vice President Purna Bahadur Khadka have previously argued that the leadership elected by the special general convention is not the legitimate leadership of the NC and have challenged its official status.

The Election Commission had recognized the Thapa-led committee as the official leadership of the NC, and the Supreme Court subsequently upheld the decision.

However, after Deuba and Khadka filed a petition seeking a review of that ruling, the Supreme Court allowed the review. As the Thapa-led leadership moved ahead with preparations for the 15th General Convention, Deuba filed the writ petition seeking to halt the process.

Former Vice President Khadka has not filed a separate writ petition. He has said that he is consulting with others on the matter.
