Nepal Medical Council places doctor on six-month probation over alleged negligence



KATHMANDU: The Nepal Medical Council has taken disciplinary action against physician Manoj Kumar Gupta, placing him on probation for six months over alleged medical negligence.

The decision was made during the council’s full board meetings held on February 23 and 24, according to registrar Satis Kumar Dev. During the probation period, Dr. Gupta will only be allowed to practice under the supervision of another physician.

The council said the decision was based on statements from doctors involved in the surgery as well as expert opinions.

The case is related to the death of 37-year-old Suresh Shah Kanu of Bara District, who had sought treatment for gallbladder problems at Prabhu Hospital and Research Center Pvt. Ltd. on October 31, 2023.

According to the complaint, Dr. Gupta advised preparations for surgery even before the gallbladder test report was available. The surgery was carried out the same day and the gallbladder was removed and sent for examination, but the report was not provided.

After the surgery, Shah’s health condition continued to deteriorate, prompting his family to take him to another hospital. Doctors there reportedly found that the surgery had been conducted without adequate examination and that cancer had spread to internal organs.

Shah later died during treatment on Shrawan 32, 2081. His family filed a complaint with the Nepal Medical Council on January 12. 2025, alleging negligence by Dr. Gupta.

Following an investigation that included direct statements from the doctors involved and expert review, the council decided to impose disciplinary action.
