Patan High Court halts Nepal Medical Association election process

KATHMANDU: The Patan High Court has issued an interim order directing the Nepal Medical Association (NMA) not to proceed immediately with the election process of its central executive committee.

A joint bench of Justices Rishipram Niraula and Deepak Khanal issued the order on Sunday while hearing a prohibitory writ petition filed by Ajay Kumar Mishra and others against the Nepal Medical Association.

According to the court, the election schedule and election bylaws made public by the NMA on October 6, 2025, were introduced without completing the mandatory procedures outlined under Rule 6 of Chapter 4 of the Association’s Election Bylaws, 2070.

The court observed that due to non-compliance with the prescribed process, the petitioners were deprived of the opportunity to participate in the election, including registering their candidacies. In such a situation, the court concluded that allowing the election process to move forward would not be appropriate.

Based on this assessment, the High Court issued the interim order in accordance with Rule 42 of the High Court Regulations, 2073. The court has also directed the respondent Nepal Medical Association to issue notice as per legal provisions and appear in the next hearing.

Following the court order, the NMA elections scheduled outside the Kathmandu Valley on January 16 and 17, and within the Kathmandu Valley on January 29, 30 and 31, have been put on hold.

Further proceedings will depend on the court’s final decision in the case.
