KATHMANDU: Pokhara High Court on Sunday postponed the hearing in the cooperative fraud, organized crime, and money laundering case involving Rabi Lamichhane and Chhabilal Joshi due to the absence of signatures on court summons.
The court mentioned that the letter sent to inform defendants Rabi and Chhabi — who are currently in custody at Rupandehi Prison — about their court appearance did not contain signatures.
A joint bench of Chief Judge Dr. Ratna Bahadur Bagchand and Judge Milan Kumar Rai, of the High Court has ordered Rupandehi Prison Office to clarify the reason behind the missing signatures on the summons letter.
The court order states, “Was the letter unsigned because the defendants refused to accept the court summons, or was it due to some other reason? Submit a report clarifying this matter.”
The court also ordered the prison to send proof if the defendants did receive the summons. Additionally, it instructed that the signatures, once obtained, be included in the case file.
Moreover, the court has ordered the original case file along with the charge sheet filed on Ashoj 18, 2080 at the Kaski District Court concerning cooperative fraud, and the charge sheet from Poush 5, 2081 related to supplementary charges, be submitted for review.
