SC seeks statement of clarification on High Court’s order to detain Rabi Lamichhane

KATHMANDU: The Supreme Court (SC) has requested a clarification report (statement) regarding the Tulsipur High Court’s decision to remand Rastriya Swatantra Party (RSP) Chair Rabi Lamichhane into custody for trial.

A single bench of Justice Tek Prasad Dhungana made the request on Sunday after completing a preliminary hearing on the matter.

The report must outline the legal grounds on which the High Court based its decision to detain Lamichhane.

The Butwal bench of the Tulsipur High Court had ordered Lamichhane’s detention.

In response, Lamichhane, who is facing charges related to the Supreme Cooperative fraud case, filed a petition at the Supreme Court on Friday challenging the order.

Following the High Court directive, Lamichhane was arrested from his residence in Budhanilkantha, Kathmandu, and flown to Butwal.

The Rupandehi District Court issued a detention warrant and remanded him to custody.

Earlier, Judge Prahlad Kumar Yogi of the Rupandehi District Court had released Lamichhane on bail of Rs 10 million, while co-accused Chhabilal Banjade was sent to custody.

A total of 42 individuals, including Lamichhane, Banjade, and GB Rai, have been named as defendants in the cooperative fraud case, which involves the embezzlement of over Rs 550 million.
