KATHMANDU: The Supreme Court has ordered the immediate release of two bodyguards of medical entrepreneur Durga Prasai, who were apprehended along with weapons from SC premises.

The division bench comprising Justices Nahakul Subedi and Sunil Kumar Pokharel issued an order to release Prasai’s bodyguards Ramkumar Dhimal and Deepak Khadka, who were detained with weapons, including a licensed firearm.

It may be noted that a writ petition had been filed in the Supreme Court by Prasai’s bodyguards, challenging their detention after the police apprehended them on March 18.

Along with the bodyguards, a licensed firearm and around 100 rounds of ammunition were seized.

The firearm license was registered in the name of Khadka.

However, the court’s rationale for not allowing the arrest of Dhimal to hand over the firearm, as Khadka was already in possession, was not accepted.

The court mentioned in its order that since the action of carrying weapons with permission and security was not seen as violating the prevailing law, no offense was found in their actions.
