KATHMANDU: The Supreme Court (SC) is hearing a writ petition lodged against the Gandaki Province government, assigning the case to Justices Sapana Pradhan Malla and Saranga Subedi.
The Nepali Congress had earlier filed a writ against Khagaraj Adhikari, the CPN-UML parliamentary party leader who assumed the Chief Minister’s role, with the Speaker’s endorsement, in Gandaki Province.
Previously, on April 10, Justice Binod Sharma, presiding as a single bench, issued an interim order barring any decisions with enduring ramifications on the chief ministerial position.
The bench scheduled a comprehensive hearing for today.
Furthermore, the court directed the government to furnish a written response by the April 19 and demanded the submission of all documents pertaining to officer appointments for the Chief Minister’s perusal.
Outgoing Chief Minister of Gandaki Province and Nepali Congress Parliamentary Party leader, Surendra Raj Pandey, has sought an interim injunction in the petition filed on April 9, seeking to halt the government formation process, which he contends violates constitutional and legal tenets.
The appointment of the Chief Minister, under the Speaker’s imprimatur, by State Chief Dilliraj Bhatta, is under scrutiny in the writ, alleging that Provincial Chief Bhatta himself contravened constitutional stipulations.
