Nepal-led Unified Socialist cannot split until Bhadra 2083

KATHMANDU: Speculation Surrounding Split of Unified Socialist Party Amidst Janata Samajbadi Party Nepal Split

Following the recent split of the Upendra Yadav-led Janata Samajbadi Party Nepal, there’s growing speculation about the potential division within other small parties.

Among them, the Madhav Nepal-led CPN (Unified Socialist) is reportedly under scrutiny for a possible split.

Reports suggest that some leaders within the Unified Socialist party have initiated discussions with the Election Commission to explore the possibility of a split.

However, the Commission has clarified that any such move cannot be executed until Bhadra 2083.

Why Can’t Unified Socialist Split?

Unified Socialist cannot undergo a split due to the regulations outlined in Article 33(2) of the Political Party Act, 2073.

According to this Act, a party formed as a result of a split cannot undergo further division until it has completed five years since its formation, regardless of the number of lawmakers or central committee members in favor of the decision.

Therefore, Unified Socialist, which originated from the split of CPN-UML in Bhadra 2087, is ineligible for a split until Bhadra 2083.

This legal stipulation ensures stability within the political landscape and prevents premature fragmentation of political entities.
