KATHMANDU: The Supreme Court has started hearing on the writ former Rastriya Swatantra Party (RSP) lawmaker Dr. Dhaka Kumar Shrestha filed against the party for expelling him.
The hearing has started in the division bench of Justices Nahakul Subedi and Kumar Regmi.
Dr. Shrestha filed a case demanding to annul the decision of the RSP Central Committee and the Disciplinary Committee to remove him from the post of the lawmaker on the charge of money transactions with medical entrepreneur Durga Prasai.
After the audio of the money transaction between Shrestha and Prasai came out, the RSP sent a letter to the Election Commission requesting to remove Shrestha as a lawmaker and appoint Bindabasini Kansakar in his place.
Coincidentally, on the same day that the Election Commission gave the certificate of MP to Kansakar, the single bench of Justice Tilkumar Shrestha gave a preliminary hearing on the writ filed by Shrestha and ordered EC not to take any action till the next verdict from the court.
Today’s hearing will decide whether to dismiss the case or continue the trial.
