KATHMANDU: The Supreme Court hearing on the writ petition challenging the government’s decision to release Resham Chaudhary, founder of the Nagarik Unmukti Party and a convicted murderer, has been assigned to Justice Kumar Regmi’s bench.
Earlier, the writ was initially scheduled for hearing on November 9 and 10 under Justice Prakash Man Singh Raut’s bench but was deferred. Today, as court proceedings resumed after a recess, the case was transferred to Justice Regmi’s bench.
Chaudhary, sentenced to life imprisonment by the Supreme Court for his involvement in the Tikapur incident, was granted amnesty based on the government’s recommendation.
Kadayat filed a petition on May 30th in the Supreme Court, seeking to overturn the President’s decision and reinstate Chaudhary’s imprisonment until his sentence is served in full.
Following the Council of Ministers’ recommendation, Chaudhary’s life sentence was commuted on Republic Day, May 29.
The Supreme Court had upheld the lower court’s ruling that found Chaudhary guilty in the Kailali Tikapur incident. However, the complete decision text was not disclosed, leading to the waiver of imprisonment.
On August 24, 2015, in Tikapur Municipality of Kailali, eight individuals, including five Nepal Police members, two armed forces personnel, and one child, were killed. Among the deceased was Senior Superintendent of Police Seti Zone Chief, SSP Lakshman Neupane. The Supreme Court identified Chaudhary as the main planner behind the incident resulting in these fatalities.
