Hearing on writ against Resham Chaudhary’s amnesty postponed

KATHMANDU: The scheduled hearing for the writ petition filed in the Supreme Court challenging the government’s decision to grant amnesty to Resham Chaudhary, the founder of the Nagarik Unmukti Party, has been deferred due to an inadequate number of Justices available at the apex court.

Chaudhary, who had been sentenced to life imprisonment by the Supreme Court for his involvement in the Tikapur incident, had his sentence commuted based on the government’s recommendation. The final hearing, which was scheduled for today, has been postponed. The petition was lodged by Sharada Kadayat, the widow of police inspector Keshav Bohra, who lost his life in the incident.

On May 30, Kadayat submitted a petition to the Supreme Court, seeking to annul the President’s decision and enforce Chaudhary’s full prison term.

As part of Republic Day celebrations on May 29, Chaudhary’s life sentence was commuted upon the Council of Ministers’ recommendation.

The Supreme Court upheld the verdict of the lower court that found Chaudhary guilty in connection with the Tikapur incident in Kailali. However, the detailed judgment remains pending, and the imprisonment was remitted.

The Tikapur incident on August 24, 2015, in Tikapur Municipality of Kailali, resulted in the deaths of eight individuals, including five Nepal Police personnel, two armed forces members, and one child, along with Senior Superintendent of Police Seti Zone Chief SSP Laxman Neupane. The Supreme Court determined that Chaudhary was the principal instigator behind the incident that claimed eight lives.
