Involving Speaker in Koshi Province govt formation unconstitutional: NC leader Koirala

KATHMANDU: Dr. Shekhar Koirala, leader of the Nepali Congress (NC), has expressed his view that seeking the Speaker’s involvement and support for the formation of the Koshi State government would be unconstitutional.

He stated that involving the Speaker in the government formation process goes against the principles of dignity, established practices, and the rule of law.

According to Koirala, there is no constitutional interpretation that justifies the involvement of the Speaker of the Province Assembly in the government formation process.

He argued that the party seeking to form the government should solely count its own members and present the Speaker with the relevant information.

However, Koirala emphasized that if it is indeed true that the Speaker has personally signed and submitted a written statement expressing support for the formation of the government, such an action contradicts the principle of constitutional supremacy and the democratic parliamentary system.

Koirala further explained that the constitutional role of the Speaker primarily entails conducting and presiding over the Legislative Parliament’s proceedings.

Engaging in activities related to the formation, dissolution, and support of the executive, as well as signing relevant documents, violates the principles of dignity, established practices, and the legal framework of parliamentary democracy, particularly when there is a tied vote on matters presented to the Parliament.
