SC stays EC code that sought elected reps’ resignation for filing candidacy in local level polls



KATHMANDU: After hearing on the writ petition filed against the local election related code of conduct issued by the Election Commission, the Supreme Court has directed the EC not to enforce the code seeking people’s representatives resignation prior to filing candidacy for the upcoming local election.

A Single Bench of Justice Bam Kumar Shrestha on Tuesday issued a short term interim order against the Election Commission’s code of conduct in this regard.

The bench also invited both the plaintiff and defendants for discussion on the matter.

Earlier, Nima Galgen Sherpa, chairperson of Helambu Rural Municipality in Sindhupalchowk, had filed a writ petition on Monday at the apex court, challenging the EC code that the incumbent local representatives should resign from their post to file their candidacy in the upcoming local election.
